DEBATE: Extraterrestrial Diplomacy Act of 2023

Representative DRAKE, for himself, introduced the following bill: 

A BILL

to enhance American capabilities relating to diplomatic relations with extraterrestrial entities by establishing the Office of Extraterrestrial Relations

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short Name

(a) This bill may be referred to as the "Extraterrestrial Diplomacy Act of 2023". 

 

SECTION 2. Establishment of the Office of Extraterrestrial Relations 

(a) There shall henceforth be established within the Department of State an Office of Extraterrestrial Relations with the primary purpose of conducting and engaging in diplomacy and other foreign affairs with extraterrestrial beings, governments, and representatives. 

(b) The Office of Extraterrestrial Relations shall be headed by the Under Secretary of Extraterrestrial Relations, who shall be appointed by the President of the United States and subject to the advice and consent of the United States Senate. 

(c) The Under Secretary of Extraterrestrial Relations shall be a human being born on Earth with no personal sworn allegiances to an extraterrestrial alliance, country, or organization.

(e) Amend 22 U.S.C. 2651a (b)(1) by replacing “6 Under Secretaries of State” with “7 Under Secretaries of State”.

 

SECTION 3. Federal Judicial Jurisdiction Concerning Extraterrestrial Beings and Institutions

(a) Amend the original jurisdiction of the federal district courts (28 U.S.C. §1331) by adding the following underlined portion: “The district courts shall have original jurisdiction of all civil actions arising under the Constitution, laws, or treaties of the United States; and shall have original jurisdiction of all civil and criminal actions between any U.S. citizen and one or more extraterrestrial beings or institutions.

(b) Amend the appellate jurisdiction of the U.S. Court of Appeals for the Federal Circuit (28 U.S.C. §1295) by adding the following under 28 U.S.C. §1295 (a): “(15) of an appeal of a civil or criminal matter between any U.S. citizen and one or more extraterrestrial beings or institutions.”

 

SECTION 3 4. Clarification Against Prohibition of Diplomacy by Other Offices

(a) Nothing in this bill shall be construed as to prevent, discourage, or prohibit other offices--such as, but not limited to, the President or the Secretary of State--from conducting or engaging in diplomacy with extraterrestrial beings, governments, or representatives.

Mr. Speaker,

I rise in support of this historic legislation, and move to make the following four amendments:


I. Replace all mentions of “Secretary of Extraterrestrial Relations” with “Under Secretary of Extraterrestrial Relations”, as to subject this official to the restrictions and authority under 22 U.S.C. §2651a et seq

 

II. Move (c) of Section 2 of this Act to (d), and add after Section 2 (b) the following:

(c) Subject to the direction of the President, the Under Secretary of Extraterrestrial Relations shall—

(1) attend and participate in meetings of the National Security Council in his role as Senior Advisor to the President on Extraterrestrial Relations; and

(2) advise, or designate an employee of the Office of Extraterrestrial Relations to advise, the Office of Science and Technology Policy on scientific and technological capabilities of extraterrestrial origins.

 

III. Add under Section 2 of this Act the following:

IV. Move Section 3 of this Act to Section 4, and add after Section 2 the following:
