Prime Minister: This session of the Constitutional Congress shall come to an order. King Herberto III has ordered that we be done with the constitution in its entirety by a certain date and we shall not break his order. Therefore, the Constitutional Congress will break into five committees:

  1. The Crown. 
  2. The Executive. 
  3. The Legislative. 
  4. The Judicial
  5. The People 

Each committee shall focus on that portion of the constitution. As I have read the committees, thats how they will be presented in the constitution. There will be four members per committee except for the Crown committee where there shall be five members. The Deputy Prime Minister and I will act as ex-officio members on every committee but shall reserve the tie-breaking vote. Let us begin!

ARTICLE I. THE CROWN

Section I. The King is the Head of State, the symbol of its unity and permanence. He arbitrates and moderates the regular functioning of the institutions, assumes the highest representation of the Spanish State in international relations and exercises the functions expressly conferred on him by the Constitution.

Section II. His title is that of King of Spain, and he may use the other titles appertaining to the Crown

Section III. The person of the King is inviolable and shall not be held accountable. His acts shall be made final and absolute. The Crown of Spain shall be inherited by the successors of H. M. Ale Reynaldo Humberto Herberto III, the legitimate heir of the historic dynasty. Succession to the throne shall follow the regular order of primogeniture and representation, the first line always having preference over subsequent lines; within the same line, the closer grade over the more remote; within the same grade, male over the female, and in the same sex, the elder over the younger. The Crown Prince, from his birth or from the time he acquires the claim, shall hold the title of Prince of Asturias and the other titles traditionally held by the heir to the Crown of Spain. Should all the lines designated by law become extinct, the Plenum shall provide for succession to the Crown in the manner most suitable to the interests of Spain. Those persons with a right of succession to the throne who marry against the express prohibition of the King, shall be excluded from succession to the Crown, as shall their descendants.

Section IV. Abdications and renunciations and any doubt in fact or in law that may arise in connection with the succession to the Crown shall be settled by an organic act.

Section V. In the event of the King being underage, the King's father or mother or, in default thereof, the oldest relative of legal age who is nearest in succession to the Crown, according to the order established in the Constitution, shall immediately assume the office of Regent, which shall exercise during the King's minority. If the King becomes unfit for the exercise of his authority and this incapacity is recognized by the Plenum, the Crown Prince shall immediately assume the Regency, if he is of age. If he is not of age, the procedure outlined in this section shall apply until the coming of age of the Crown Prince. If there is no person entitled to assume the Regency, it shall be appointed by the Plenum and shall be composed of one, three, or five persons. In order to exercise the Regency, it is necessary to be Spaniard and legally of age. The Regency shall be exercised by constitutional mandate, and always on behalf of the King.

Section VI. It is incumbent upon the King to:

  1. Summon and dissolve the Plenum and to call for elections under the terms provided for in the Constitution.
  2. Call for a referendum in the cases provided for in the Constitution.
  3. To propose a candidate for President of the Government and as the case may be, appoint him or remove him from office as provided for in the Constitution.
  4. Appoint and dismiss members of the Government with or without the President of the Government's proposal.
  5. Issue decrees as determined by the King.
  6. Issue decrees approved in the Council of Ministers, to confer civil and military positions and award honors and distinctions in conformity with the law.
  7. Be informed of the affairs of State and, for this purpose, preside over the meetings of the Council of Minister whenever he sees fit or at the request of the President of the Government.
  8. Exercise supreme command of the Armed Forces.
  9. Exercise the right of granting pardons.
  10. Exercise the High Patronage of the Royal Academies.

Section VII. The King accredits ambassadors and other diplomatic representatives. Foreign representatives in Spain are accredited before him. It is incumbent upon the King to express the State's assent to international commitments through treaties, in conformity with the Constitution and the laws. It is incumbent upon the King to declare war and to make peace at will.

Section VIII. The King's acts shall always be final and absolute.

Section IX. The King receives an overall amount from the State Budget for the maintenance of his Family and Household and distributes it freely. The King freely appoints and dismisses civil and military members of his Household.

ARTICLE II. EXECUTIVE

ARTICLE III. LEGISLATIVE

Section I. All legislative powers herein granted by the King of Spain shall be vested in a Plenum of the Kingdom of Spain, which shall consist of a Senate and House of Trustees.

Section II. The House of Trustees of the Kingdom of Spain shall be composed of Members chosen every second Year by the People of Spain. No Person shall be a Trustee who shall not have attained to the Age of twenty-four Years, a Spanish-born citizen, and a resident of their electoral Province. The House of Trustees shall have a total of 415 members; eight per electoral province, five per autonomous city, and five appointed as representatives of the Crown of Spain. When vacancies happen in the representation from any province, city, or Crown, the Executive authority thereof shall appoint someone to fill such vacancies for the remainder of the term. The House of Trustees shall choose their Speaker and other Officers.

Section III. The Senate of the Kingdom of Spain shall be composed of 140 Members; two appointed by the legislature of each autonomous region, two appointed by the legislature of each autonomous city, two appointed by the legislature of each province, and two appointed by the Crown of Spain; whom shall serve four-year terms. Former Presidents of the Government are Senators by Right and for Life unless they renounce the Office. No Person shall be a Senator who shall not have attained the Age of thirty-Years, a Spanish-born citizen, and a resident of their appointed autonomous region. The Crown Prince, upon reaching maturity, shall be the presiding officer of the Senate, but shall have no Vote, unless they be equally divided. If the Crown Prince is not of maturity age, the King of Spain shall appoint a member of the Royal Household to serve as President of the Senate until the Crown Prince reach maturity age.

Section IV. The times, places and manner of holding elections for Senators and Trustees shall be prescribed in each autonomous region by the legislature thereof; but the Plenum may at any time by Law make or alter such regulations as applicable to this constitution.

Section V. Each chamber shall be the judge of elections, returns and qualifications of its own members, and a majority of each shall constitute a quorum to do business; but a smaller number may adjourn from day to day, and may be authorized to compel the attendance of absent members, in such manner, and under such penalties as each chamber may provide. Each chamber may determine the Rules of its Proceedings, punish its Members for disorderly Behavior, and, with the Concurrence of two thirds, expel a Member. Each chamber shall keep a Journal of its Proceedings and from time to time publish the same, excepting such Parts as may in their Judgment require Secrecy; and the Yeas and Nays of the Members of either Chamber on any question shall, at the Desire of one fifth of those Present, be entered on the Journal. Both Chambers of the Plenum shall convene a regular session on the Second Monday in January until the last Friday in May. Neither Chamber, during the Session of Plenum, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Chambers shall be sitting.

Section VI. Upon authorization from the King of Spain, the Senators and Trustees shall receive Compensation for their Services paid out of the Treasury of the Kingdom of Spain. No Senator or Trustee shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the Kingdom of Spain, which shall have been created, except for the Council of Ministers.

Section VII. All Bills for raising Revenue shall originate in the House of Trustees; but, the Senate may propose or concur with Amendments as on other Bills.

Members of the House of Trustees entered into the Congressional Palace and took their seats on the left side while the Senate sat on the right side of the floor of the House of Trustees. Members of the Constitutional Congress took their seats at the center of the Trustees floor. The sound of the royal march rang through the chamber as everyone in the building rose as the King was being presented by the Regent, Julio Cortez.

Julio: All rise for His Royal Majesty, King of Spain, Ale Reynaldo Herberto Humberto III.

The audience and members of Congress stood and bowed as the King gracefully walked down the aisle to take the presiding officers chair. As he sat, other began sitting down but not before saying "Long live the King!"  King Humberto III raised his right hand and the room fell silent.

King Humberto III: Prime Minister, Members of the House of Trustees, members of the Senate and members of the Constitutional Congress, all gathered here under one roof under my name, I would like to formally welcome you to the first session of the Constitutional Congress. We are here to achieve one goal in my name, the creation and completion of the Spanish Constitution. I have named myself the presiding officer for this session because this is very important to the Spanish people and I have personally promised the people while as Prime Minister, I will push to get General Franco to have a Constitution created. As former Prime Minster, the preceding and protocols are well known to me. Without further or due, Mister Prime Minister, please read the report of the Constitutional Congress of the proceedings that took place.

Prime Minister: Your royal majesty, members of Congress, it was an honor serving as the presiding officer of the King's Constitutional Congress. The report reads as follows:

On February 01, 1946, the Congress convened after the royal decree issued by the King established the Constitutional Congress and the priority thereof. The Prime Minister, the presiding officer of the Congress, created five separate committees that worked on certain aspects of the Constitution. The committees are as follows:

  • The Crown
  • The Executive
  • The Legislative
  • The Judicial
  • The People

The committees began their work immediately. On March 22, 1946, the Crown committee completed their portion of the Constitution and the members thereof were split off into the other four committees. The Crown committee was the only committee to complete their portion of the work. The Executive, the Judicial and the People committees were unable to agree on any aspects of how powerful each should be. The Legislative committee completed their work on November 12, 1946 but more than half of their worked was destroyed in water damage and lost as a result. The Constitutional Congress requested two extensions from the King to complete its work.

The Constitutional Congress disbanded on January 01, 1947 by order of the King.

I would like to add, Your Royal Majesty, the Constitutional Congress worked tirelessly on building the structures and the structures, if we may, can be presented before the body here today. Thank you.

King Humberto III: Thank you Mister Prime Minister. Now we'll have the reading of the Constitution draft made by the Senate leader.

The Senate leader stood.

Senate Leader: Your Royal Majesty, I ask for unanimous consent that we bypass the reading of the Constitution draft since we all had an advance copy on January 5th. 

King Humberto III: Without objection, so ordered. The reading of the Constitution shall be bypassed. Members of Congress shall have until next Monday to bring their proposals to the floor. The court is adjourned until Monday.

With that, the court was adjourned. You can see His Royal Majesty step down from the presiding officer's chair and exit the Congressional Palace. Everyone stood and bowed as the King passed by and waited until he fully exited the chamber before following behind. We don't know what to expect next week, but the question still lingers, will they get it done in such a short amount of time?

King Humberto III: Mister Prime Minister, members of the Senate, members of the House of Trustees, I urge you for the next couple of weeks to work diligently and efficiently to draft important parts of the Spanish Constitution. Starting today, members of this body will be broken into committees to work on portions of the Constitution. The deadline is set for March 1st.  Without further or due, Regent Julio Cortez shall call out the members of each committee and the chairs of each committee. Afterwards, the body is dismissed to their committees until March 1st.
